Preliminary Affirmative AD/CV Injury Determinations on Certain Pipe. The USITC has issued preliminary affirmative injury determinations in its AD and CV investigations of certain mainland Chinese seamless carbon and alloy steel standard, line and pressure pipe classified under HTSUS 7304.19.1020, 7304.19.1030, 7304.19.1045, 7304.19.1060, 7304.19.5020, 7304.19.5050, 7304.31.6050, 7304.39.0016, 7304.39.0020, 7304.39.0024, 7304.39.0028, 7304.39.0032, 7304.39.0036, 7304.39.0040, 7304.39.0044, 7304.39.0048, 7304.39.0052, 7304.39.0056, 7304.39.0062, 7304.39.0068, 7304.39.0072, 7304.51.5005, 7304.51.5060, 7304.59.6000, 7304.59.8010, 7304.59.8015, 7304.59.8020, 7304.59.8025, 7304.59.8030, 7304.59.8035, 7304.59.8040, 7304.59.8045, 7304.59.8050, 7304.59.8055, 7304.59.8060, 7304.59.8065 and 7304.59.8070. As a result, the DOC will continue its AD and CV duty investigations of imports of subject merchandise. The DOC is scheduled to issue its preliminary CV determination on 10 December and its preliminary AD determination on 23 February 2010.

Initiation of Section 337 Investigation of Certain Ink Supplies and Components. The USITC has initiated a Section 337 patent infringement investigation of certain inkjet ink supplies and components thereof used in inkjet printers from various suppliers, including Hong Kong’s Mipo International Ltd. and mainland China’s Zhuhai Gree Magneto-Electric Co. Ltd., Shanghai Angel Printer Supplies Co. Ltd., Shenzhen Print Media Co. Ltd., Zhuhai National Resources & Jingjie Imaging Products Co. Ltd., Tatrix International and Ourway Image Co. Ltd. The complainant is seeking relief in the form of exclusion and cease and desist orders.

Section 337 Investigation of Certain Flash Memory Products Terminated. On 12 December 2007, the USITC instituted a Section 337 investigation of certain flash memory controllers, drives, memory cards, and media players and products containing the same from various sources, including Hong Kong and mainland China. Several respondents were subsequently terminated from the investigation based on settlement agreements, consent orders and the withdrawal of allegations from the complainant. On 10 April, the administrative law judge assigned to this case found no violation of Section 337. The USITC subsequently reviewed and confirmed that finding.

Scheduling of Full Sunset Review of AD Duty Order on Chloropicrin. The USITC has scheduled a full sunset review of the AD duty order on chloropicrin from China. The review will seek to determine whether revocation of this order would be likely to lead to continuation or recurrence of material injury to a domestic industry within a reasonably foreseeable time. The pre-hearing staff report will be placed in the non-public record on 29 January 2010 and a public version will be issued thereafter; pre-hearing briefs are due by 8 February; requests to appear at the hearing are due by 10 February; the pre-hearing conference will be held on 12 February; the hearing will be held on 18 February; and post-hearing briefs are due by 1 March.

Scheduling of Expedited Sunset Review of AD Duty Order on Tetrahydrofurfuryl Alcohol. The USITC has scheduled an expedited sunset review of the AD duty order on tetrahydrofurfuryl alcohol from mainland China.  The review will seek to determine whether revocation of this order would be likely to lead to continuation or recurrence of material injury to a domestic industry within a reasonably foreseeable time. The staff report was placed in the non-public record on 2 November and a public version will be issued thereafter. Comments and statements are due by 5 November and may not contain new factual information.
