Canada Makes Final Affirmative AD Determination on Mattress Innerspring Units. On 26 October, the Canada Border Services Agency made a final affirmative determination in its AD investigation of certain mainland Chinese mattress innerspring units, with or without edgeguards, used in the manufacture of innerspring mattresses, classified under HTSCA 7320.20.9010, 9404.10.0000 and 9404.29.0000. If the Canadian International Trade Tribunal issues a final injury determination, the CBSA will assess AD duties on all appropriate entries using the rates shown in the table below.

Canada Issues Preliminary Determination in AD/CV Investigations of OCTG. On 23 October, the CITT issued a preliminary injury determination in its AD and CV investigations of certain oil country tubular goods from mainland China. The scope of these investigations covers OCTG made of carbon or alloy steel, welded or seamless, heat-treated or not heat-treated, regardless of end finish, having an outside diameter from 2.375 inches to 13.375 inches (60.3 mm to 339.7 mm), meeting or supplied to meet American Petroleum Institute specification 5CT or equivalent standard, in all grades, excluding drill pipe and excluding seamless casing up to 11.75 inches (298.5 mm) in outside diameter. These items are generally classified under HTSCA 7304.29.0031, 7304.29.0039, 7304.29.0051, 7304.29.0059, 7304.29.0061, 7304.29.0069, 7304.29.0071, 7304.29.0079, 7304.39.1000, 7304.59.1000, 7306.29.1011, 7306.29.1019, 7306.29.1021, 7306.29.1029, 7306.29.1031, 7306.29.1039, 7306.29.1041, 7306.29.1049, 7306.29.9011, 7306.29.9019, 7306.29.9021, 7306.29.9029, 7306.29.9031, 7306.29.9039, 7306.29.9041 and 7306.29.9049. The CBSA is expected to issue its preliminary determination by 23 November.

Argentina Issues Affirmative Dumping Determinations on Steel Cutlery and Pipe Fittings, Initiates Proceeding on Certain Heating Apparatus. Argentina’s Ministry of Production has issued separate final affirmative determinations in its AD investigations of certain steel cutlery and steel pipe fittings. The ministry established an AD duty of 1,450.21 percent on mainland Chinese stainless steel cutlery classified under NCM 8211.10.00, 8211.91.00, 8215.20.00 y 8215.99.10, effective from 27 October 2009 through 26 October 2014. The ministry also established a minimum FOB price of US$3.94 per kilogram on imports of mainland Chinese carbon steel pipe fittings manufactured in accordance with ASME B16.9 and ASTM A234 or an equivalent standard, with an external diameter between 60.3 mm and 323.8 mm, in standard and extra heavy-duty thicknesses, classified under NCM 7307.19.20 and 7307.93.00. While imports of lower-valued items are allowed, importers are required to guarantee payment of the difference in each of those circumstances. This measure entered into force on 24 October and will expire on 23 October 2014.

Separately, the Department of Industry, Commerce and Small and Medium Enterprises has initiated an AD investigation of mainland Chinese electric space heating apparatus and electric soil heating apparatus, excluding oil radiators and storage heating radiators, classified under NCM 8516.29.00. Argentinean Customs will begin requiring certificates of origin for subject merchandise from 19 January 2010.

Brazil Issues Final Negative Determination in AD Investigation of Certain Polypropylene Film. On 14 October, Brazil’s Ministry of Development, Industry and Trade issued the final results of its AD investigation of mainland Chinese bi-axially oriented polypropylene film with no graphical impression, classified under NCM 3920.20.19. The MDIT determined that, while imports of subject merchandise were sold at less than fair value during the period of review, these imports did not cause or threaten to cause injury to a domestic industry. Therefore, the MDIT issued a final negative determination in this investigation and terminated the proceeding without the imposition of any measures.
