China Labor and Social Security News - According to Guo Li's labor contract with her employer, social insurance premiums are paid based on her basic salary. Her receivable pay consists of the basic salary, bonus, allowance and subsidy. Guo raised an objection to the practice when leaving, while the company claimed it is a stipulation made by both parties. But the arbitration committee believes that the stipulation is illegal and should be regarded as invalid; the total pay should be the base for payment of social insurance.
