Labor Contract Violations

Wang recruited to a company engaging in sales after graduating from college 2007, and signed a 5-year labor contract. Wang gave his graduation certificates to the company according to their request for he did not want to cause any trouble. Wang submitted his resignation due to family emergency in Sep 2009, but the company asked him to pay RMB 5,000 for the breach compensation or he could not get his graduation certificates. After the arbitration, the company gave the documents back to Wang.
Sun worked as a sales manager in a technology company, and signed a confidentiality agreement with the company. But the agreement merely included the obligations and responsibilities of Sun, and did not contain any information about the non-competition period and compensation. Sun terminated labor contract with the company in March 2009 and worked in another company. The extra company applied for arbitration to request Sun to pay liquidated damages. But the arbitration rejected the application for the non-competition agreement was valid.
