High advertising commission was not written in the labor contract, the employee requested for RMB 1.83 million when dismissal. the arbitration rejected Jiang’s application in August 2009. Jiang appealed to Tianhe District Court and said though the commission was not written in labor contract, but the company has sent mails or advertised to inform the salesman. So far, the case was still pending.

Lin was sent to a textile factory by a staffing agency and signed a labor contract with the agency, but he did not finish the social insurance procedures. China Center experts expressed that the social insurance procedures should be handled by the employment units, that is the unit that signed labor contract and established labor relations with Lin, and the amount shall be agreed in the dispatch agreement by the textile factory and the staf
fing agency.
