Initiation of Section 337 Investigation of Products Containing Creatine Ethyl Ester. The USITC has initiated a Section 337 investigation of certain products advertised as containing creatine ethyl ester made in mainland China. This investigation involves alleged infringements of Section 337 by reason of false advertising. Section 337 allows the USITC to investigate whether there is unfair competition in the importation of products or their subsequent sale in the U.S. Such unfair competition may include infringement of patents, copyrights and registered trademarks.

Civil Penalty Comments Sought in Section 337 Proceeding on Ink Cartridges. The USITC has decided not to review an enforcement initial determination issued by the presiding administrative law judge in the Section 337 investigation of certain ink cartridges and components thereof from various sources, including Hong Kong and mainland China. The ALJ found a violation of cease and desist orders and a consent order. The USITC may levy civil penalties for violation of these orders and is seeking comments by 3 July on the amount of civil penalties to be imposed. Any reply submissions must be filed by 13 July.
