U.S. States of New Hampshire and Kentucky Propose Ban on BPA

The States of New Hampshire¹ (NH) and Kentucky² (KY) have introduced bills that propose to ban the manufacture and sale of reusable food or beverage containers containing BPA starting 1 January, 2013.

Several States and local jurisdictions in the US, reacting to rising concerns about the risks to children, have enacted laws banning the chemical bisphenol-A (BPA) in food and beverage containers. The States of NH and KY have proposed laws prohibiting BPA beginning 1 January, 2013.

The scope of the proposed laws bans the manufacture, sale, or distribution into commerce:

  • of reusable baby food or beverage containers
  • of any infant formula or baby food stored in a plastic container, can or jar, and
  • prohibits replacement of BPA with any other chemical deemed carcinogenic by the United States Environmental Protection Agency (EPA)

Both State bills require manufacturers to use the least toxic alternative when replacing bisphenol A.  Neither bill provides any information regarding an acceptable level of BPA that finds its way into the covered articles through recycling of plastics.
