The Food and Drug Administration has amended its regulations to require effective from 18 November 2013 the listing on food labels of the common or usual names of all colour additives required to be certified by the agency. The final rule also seeks to make the animal food labelling regulations consistent with the regulations regarding the declaration of certified colour additives on the labels of human food. In addition, the rule suggests appropriate terminology for the declaration of certification-exempt colour additives on the labels of animal food.
The FDA indicates that a colour additive or the lake of acolour additive subject to certification under section 721(c) of the Federal Food, Drug, and Cosmetic Actmust bedeclared by the name of the colouradditive listed in the applicableregulation, except that it is not necessaryto include the "FD&C&"' prefix or theterm "No." in the declaration, but the term "Lake" must be included in the declaration of the lake of the certified colour additive (e.g., Blue 1 Lake). Manufacturers may parenthetically declare an appropriate alternative name of the certified colour additive following its common or usual name. Colour additives not subject tocertification may be declared as "Artificial Color," "Artificial Color Added" or "Color Added" (or by anequally informative term that makes clear that a colour additive has been usedin the food). Alternatively, such colour additives may be declared as ''Coloredwith ______'' or ''______ color,'' the blank to be filled with the name of the colour additive listed in the applicable regulation.
