Canada Finds that Dumped Mainland Chinese Footwear Does Not Injury Domestic Industry. The Canadian International Trade Tribunal determined on 25 September that imports of certain waterproof footwear and waterproof footwear in nearly finished form from mainland China that the Canada Border Services Agency had found to be sold in Canada at less than fair value have not caused and are not threatening to cause injury to a domestic industry. As a result, Canada has terminated this AD proceeding without the imposition of any measures. The proceeding affected footwear classified under HTSCA 6401.10.1100, 6401.10.1900, 6401.10.2000, 6401.92.1100, 6401.92.1200, 6401.92.9190, 6401.92.9290, 6401.99.1100, 6401.99.1200, 6401.99.1900, 6401.99.2000, 6402.19.9090, 6402.91.1000, 6402.91.9091, 6402.91.9092, 6402.91.9093, 6403.19.9090, 6403.40.0010, 6403.91.0091, 6403.91.0092, 6403.91.0093, 6404.11.9990, 6404.19.9020, 6404.19.9091, 6404.19.9092 and 6404.19.9093.
Argentina Issues Dumping Determinations on Tableware/Kitchenware and Certain Fibre and Yarn from China, Renews AD Duty Order on Bicycle Tyres. Argentina’s Ministry of Production has issued a preliminary affirmative determination in its AD investigation of the following products from mainland China: (1) textured filament yarn of polyesters (except sewing thread), of more than 80 decitex but equal to or lower than 350 decitex, classified under NCM 5402.33.00; and (2) polyester staple fibre, not carded, combed or otherwise processed for spinning, classified under NCM 5503.20.90. The MOP established a minimum FOB price of US$1.85 per kilogram for imports of subject merchandise classified under NCM 5402.33.00, and a minimum FOB price of US$1.55 per kilogram for imports of subject merchandise classified under NCM 5503.20.90. While imports of lower-valued items are allowed, importers are required to guarantee payment of the difference in each of those circumstances. This measure entered into force on 25 September and will remain in force for four months.
The MOP has also issued a final affirmative determination in its AD investigation of mainland Chinese tableware, kitchenware, other household articles and toilet articles, whether or not of porcelain or china, classified under NCM 6911.10.10, 6911.10.90, 6911.90.00 and 6912.00.00, establishing a minimum FOB price of US$4.65 per kilogram for imports of subject merchandise. This measure entered into force on 25 September and will remain in force for five years.
Finally, the MOP has renewed the AD duty order on mainland Chinese bicycle tyres classified under NCM 4011.50.00. As a result, imports of subject merchandise will continue to be subject to a minimum FOB price ranging from US$2.59 to US$2.71 per kilogramme.
Brazil Rescinds AD Duty Order on Bicycle Tyres. Brazil’s Ministry of Development, Industry and Trade has terminated its sunset review of the AD duty order on mainland Chinese bicycle tyres classified under NCM 4011.50.00. As a result, the AD duty order on subject merchandise has been rescinded. Imports of subject merchandise had been subject to an AD duty of US$1.45 per kilogramme.
