International IP Dispute Resolution – A New Chapter for Hong Kong

The growth of intellectual property (“IP”) trading worldwide brings about the proliferation of IP disputes and thereby raises the awareness of the urgent need for the legal protection of IP rights. International arbitration and mediation are the most common and cost-effective options for dispute settlement. In this connection, Hong Kong offers an ideal neutral venue to resolve cross-border IP rights-related disputes, particularly in the context of the “Belt and Road” Initiative and the Guangdong - Hong Kong - Macau Bay Area development plan. As a premier IP trading hub in the Asia- Pacific region, Hong Kong lawyers and dispute resolution practitioners are well-placed to provide outstanding service of cross-border dispute resolution by arbitration and mediation. Hong Kong’s recent legislative amendments introduced by the Arbitration (Amendment) Ordinance 2017 (“2017 Ordinance”) seek to clarify that all disputes over IP rights may be resolved by arbitration, and that it is not contrary to the public policy of Hong Kong to enforce arbitral awards involving IP rights. In this session, a distinguished panel of international experts will offer practical tips for mapping out strategies on cross-border legal risk management of IP rights. They will explain how arbitration of IP rights may achieve remarkable results when compared with court litigation in terms of resolution of multi-jurisdictional disputes and worldwide enforcement of awards. Participants will gain better understanding of the key provisions of the 2017 Ordinance and its scope of application. There will also be explanations of different mediation models (e.g. facilitative and evaluative) with case studies so that the most appropriate choice can be made.

The Trend of Film Adaptation
(Co-organised with China Daily)


In 2016, almost half of the movies which topped RMB100 million in the China box office were IP-adapted films. Together, they contributed 35% of the total box-office revenues and accounted for 38.49% of films that exceeded RMB100 million in receipts. Most of them were adapted from literature, followed by animation. With the "Warcraft: The Beginning" adaptation released last year, a cool RMB1.47 billion flooding into the industry and the increase in subscribers of Chinese internet animation, the video game genre is expected to continue to grow. Will animation and gaming be the cash cow for movie adaptation? How do we recognise good IP and adapt a story for a movie? What's coming next to film IP adaptation?

Digital Media and IP Management Trend

An increasing amount of media content, ranging from music and video productions, literary work, to computer games and software, is now distributed in digital form. Engineers and designers also routinely share their work through digital media. Managing the intellectual property of their work is crucial to sustaining the creativity of artists, designers and engineers involved in these endeavors.

As the global political climate becomes increasingly turbulent, business leaders need to work smarter and more efficiently to fend off fierce competition. Innovation is key to success but maximising your potential through intellectual property is imperative. As one of the world’s leading innovative countries, the United States has much to offer by way of lessons in using this important resource.

We will discuss the pros and cons of the four pillars of IP protection, as well as the new intangible assets, through such cases as Apple, Uber, and Facebook. IP Enforcement Strategies from a Fashion Industry Perspective


Infringers have become much more sophisticated, with many moving away from 100 per cent knock-offs (ie counterfeits) to imitation products (ie infringing products) which adopt similar designs or incorporate certain salient design features of your products. The infringing products may be displayed side by side with the genuine products or sold under a similar company name/social media username, making brand owners' IP enforcement work much more challenging.
